J&K became a part of India after India militarily stopped the invasion, plunder and forcible take over of that territory by others, and not because IoA signing (1947) granted the control of J&K to India.
Moreover, without even mentioning Article 370 in the Indian Constitution since the latter did not come into existence until 1950, how was the original IoA (signed in 1947) going to take effect given the following real situation in Kashmir?

Instrument of Accession (IoA) signed by the king of Kashmir with India in Oct. 1947 was a tool for a peaceful unification of Kashmir with India in the light of invading Pakistani attackers who had already captured by force a large part of Kashmir and were on the verge of overrunning and capturing the rest of Kashmir by force, rather than as a precursor to Article 370 in Indian Constitution which originated in Jan. 1950.
